I-130 approved but it says that I am not eligible to adjust status at this time, I'm here legally on a student visa and never over stayed?
I am 19 years old, living in the US, my dad (permanent resident) applied I-130 for me and it just got approved. My priority date is Aug 21 09. I received it Aug 20 10.
So does it mean I am not eligible at this time just because my visa category was not current, The Visa Bulletin for this month (Sep) shows that the cut off date is Jan 1 10
Will the <a href='http://www.uscis.gov/portal/site/uscis' target='_blank' class='gal' onmouseover='GAL_popup(this,"1", 200, "style=\"border: 1pt solid #000000;\"", "US Citizenship & Immigration Services", "style=\"background: #FFFFCC;padding: 2px;font-size: 12px;\"");' onmouseout='GAL_hidepopup();'>USCIS contact me, or should i just go ahead and file the I-485?? NVC never got my case, but I have two other siblings that my dad filed for them I-130 for concealer processing and their cases were transferred to NVC, and I just checked the NVC phone statues update and my case was not received actually it was not supposed to (USCIS never sent it) but my siblings' statuses were (notification to beneficiary) whatever this means?

The petitioner (dad) is not in the states at the moment, so who can I (beneficiary) contact USCIS, NVC or I can do nothing?

I guess my question is when is the IV # becomes available to a person, is it when they have an approved petition and when the Visa Bulletin shows that the category is current, or should I be waiting for a letter informing me to file I-485?? who is it going to be from (NVC or USCIS) please help, thanks for all of you!

This was in the NOA
The above petition has been approved . The petition indicates that the person for whom you are petitioning is in the United States of America and will apply for adjustment of status . The information submitted with the petition shows that the person for whom you are petitioning is not eligible to file an adjustment of status application at this time.

Additional information about eligibility for adjustment of status may be obtained from the local USCIS office serving the area where the person for whom you are petitioning lives.

Until the person for whom you are petitioning files an adjustment application, or applies for an immigrant visa, this approved petition will be stored in this office. If the person for whom you are petitioning becomes eligible to adjust status based on this petition, he or she should submit a copy of this notice with Form I-485, Application for Permanent Residence. Form I-485 may be obtained at the local USCIS office.

If the person for whom you are petitioning decides to apply for an immigrant visa outside the United States based on this petition, the petitioner should file form I-824, Application for Action on an Approved Application or Petition, with this office to request that we send the petition to the Department of State National Visa Center.

The NVC processes all approved immigrant visa petitions that require consular action, The NVC also determines which consular post is the appropriate consulate to complete visa processing. It will then forward the approved petition to that consulate.

Hi All ,

Hope every thing is great

I am Egyptian who is on B1/B2 , i am going to marry US Citizen and she is going to file a PR request for me shortly .

i have several questions and i feel a bit i confused due to several opinions i hear from different lawyers

The questions are :

1-if i returned Egypt soon after she file the request for me and waited there until the decision appear ..would that weaken my application position ??

2-One lawyer told me that immigration checks on my address are not sudden and must be pre-coordinated with my attorney and that not staying with my wife in same apartment would not affect my application status and would be seen normal .

while other one told me that those checks are sudden and that i must accommodate in the same place with my wife or the immigration would view it fraud .

3-one lawyer told me it would talk from 12-18 months to hear the court decision in my PR application while other said it often take 3 years

Please .. tell me what you see right from the above mentioned
